Terms & Conditions - Swansdown Lodge Guests agree that the property will be used in a proper and responsible manner and that they will: • Take all reasonable care of the property, its fixtures and fittings and will leave them on the departure day in the same clean and tidy condition as on the day of arrival. All rubbish to be removed, crockery washed and the fridge/freezer emptied of food. The bathrooms to be wiped over and beds stripped prior to departure. • Any accidental damage to the property or fixtures and fittings to be notified to Buckshaw Homes as soon as possible, so an agreement can be made. • Not cause a nuisance and will be considerate to the occupiers of adjoining properties. Please note that Swansdown Lodge is located in a holiday park and the Park Manager shall take action, including removal, for inappropriate behaviour. • Not alter the property, fixtures or fittings or overload the electrical system. • Ensure that they are responsible for the behaviour of their children, pets and guests at all times. • Smoking: we operate a non smoking policy. Should a guest smoke in the property the booker shall be liable for additional cleaning charges. • Pets: Please ensure they are flea free and wormed before arrival. Do not allow them on the furniture or beds. Should your dog have an accident on the deck or garden areas please clean and wash down with the hose provided. Do not leave your pets unattended at the property. • The property is to be used solely as self catering accommodation. Strictly NO parties unless written permission is given. Occupation It is the Booker’s responsibility to ensure the property is suitable for the number of guests in their party and that they will not exceed the maximum occupancy rate of the property. No bookings are accepted from groups where the whole party is aged 25 or under. Check in and out times. We like to ensure that each property is in perfect condition for your stay and quite often yourarrival is on the same day as the departure of another guest. Check in is no earlier than 4.00pm and check out is by 10am to give us sufficient time to clean and prepare the property. However we try to be as flexible as possible and if you need to check in or out at different times please let us know in advance. Reservations As part of the reservation procedure we may require a completed Booking Contract. This will besent out to the Guest either by post or email. The Booking Contract needs to be completed and returned so the booking can be confirmed and processed. Reservations are confirmed only when we have accepted the booking in writing or by email. The contract is made when we confirm the reservation and the Guest has, where required, paid the Booking Deposit. Reservations will be confirmed in writing or via email and will state the dates of arrival and departure. A confirmed reservation for which the Guest has paid all due charges gives the Guest and his party consisting only of those persons named on the Booking Contract permission to occupy the property, in accordance with these terms and conditions, for the period for which the charges have been paid. These terms and conditions apply equally to the Guest and those in the Guest’s party. We reserve the right to refuse, at our sole discretion, any booking you make with us. It is the responsibility of the Guest to notify us at the time of booking of the names of the relevant guests and whether they are adults or minors, on the Booking Contract. You are advised to ensure that you put in place appropriate travel insurance policies to cover cancellation, medical cover and cover for loss or damage to personal property during your stay. Payment • Payment Method: All payments must be made to the owns directly. Payment can be made by electronic bank transfer, cheque, debit card, Visa or MasterCard credit cards. Sorry, Amex and Diners Club cards are not accepted. • Booking Deposit: A deposit of 30% of the total rental is payable upon making a Reservation. • Additional Cleaning/Security Deposit: An undated cheque for £200 may be required in addition to the Booking Deposit. In the event that the Guest or anyone in their group staying at the Property causes either excessive damage, or incurs a need for extra cleaning, or leaves the Property without settling invoices for additional services or supplies received during their stay. Then the cost of this shall be taken from the Security Deposit. If everything is in order at the Property at the end of the Guest’s stay the cheque will then be returned 10 days after departure. • Balance: The remaining 70% of the total rental becomes payable 8 weeks before the start of the let, this must be paid within 7 days of falling due, otherwise the owner may cancel the booking. Should a booking be made within 8 weeks of the start of the let, then the full rental becomes due on booking plus the Cleaning/Security Deposit as outlined above. Cancellation Any cancellation made by the Guest for whatever reason, shall be via email or telephone call backed up by an email to the owners. If the cancellation notice is received by the owners more than 8 weeks from the start of the rental period, then only the deposit is forfeited. If a booking is cancelled within 8 weeks of the start of the rental period then the whole rental amount is forfeited. The owners strongly recommends Guests to take out Cancellation Insurance. Change of Dates The owners will consider a request from a Guest to change the dates of the booking after confirmation has been issued (subject to availability). Agreement will be given subject to the request being received more than 12 weeks before the commencement of the booking and upon the Guest paying an administration fee of £20.00. If a request is made within 12 weeks of the start of the rental all efforts will be made to help, but if new dates can’t be agreed and the booking is cancelled please see above cancellation policy. Rates All rates quoted are based on the rates prevailing at the time that a booking is confirmed (in UK Pounds). Once a booking has been confirmed we will not change the rate quoted unless you amend the booking but otherwise rates are subject to change without notice. Period of Occupation A property is available for occupation from 16:00 hours on the day of arrival to 10:00 hours on the day of departure. Any additional hours of occupation outside the available times in each period of 24 hours will be charged as one extra day unless otherwise agreed. Early check in/late check out cannot be guaranteed unless the booking is made from the night before arrival/for the night after departure. Use of Property The number and identity of the persons occupying a property must be the number and identity of persons notified by the Guest in the Contract. Any change in the identity of Guests and their party must be notified in advance of the commencement of the booking. The Property will be used for personal, domestic purposes only and cannot be sub-let to third parties. The Property shall not be used for any commercial purposes without the prior consent of the owners; who reserve the right to refuse entry to the entire party if this condition is not observed. No Tenancy For the avoidance of doubt any agreement shall not create the rights or obligations of a landlord to a tenant and no rights of tenancy are created. If this contract is with an individual person (as opposed to a company) then by entering into this agreement the person is declaring that the property booked is not intended to be his/her principal place of residence. Extending your Stay If you wish to extend a stay please give as much notice as possible in order to facilitate your request. All extensions are subject to availability and rate change. Where notice of intention to extend your stay has been given, an invoice for the requested extended period will be sent to the billing address provided at the time of booking and payment must be made by return. Keys and Security Devices Directions and instructions will be sent out only after a booking has been paid in full. The property does not have a manned reception, so door codes will be given two days before the booking commences. It is then the booker’s responsibility to ensure that the guests have the access codes and other relevant information, provided to them by us to allow guests to access the apartments. The Park requires a key for entry and exit. Keys will be provided on arrival or by prior arrangement. Lost security fobs will be charged at £100 each. The Owner or representative will provide keys and instructions on arrival Inspection Guests agree to allow the owners or their representatives to have access to the property at all reasonable times for the purpose of inspection, maintenance, repair or viewing. Data and Internet The lodge does not have telephone access as this is not permitted on the site. However, the Park does have wireless internet which can be found at various locations but is generally strongest near the club house. Lost property We shall use reasonable endeavours to retain any items left for up to 3 month after the guest’s departure date. It is the guest’s responsibility to recover any left items. We do not take any responsibility for any left items. In individual circumstances we have complete discretion in treating an item as being abandoned rather than lost. Liability Lliability is between the Owner and Guest. We are not responsible for the theft and/or damage of your personal belongings during your stay in any properties booked. Therefore you are advised to ensure you have appropriate insurances in place. All warranties, conditions and other terms implied by statute or common law or otherwise are, to the fullest extent permitted by law, excluded from any contract with us and these conditions shall apply in their place. However, nothing in these terms and conditions shall affect your statutory rights if you are a consumer. Nothing in these terms and conditions limits or excludes the liability of us for death or personal injury resulting from negligence; or for any damage or liability incurred by you as a result of fraud or fraudulent misrepresentation by us, or any liability that cannot by law be excluded. Subject to the paragraph above, we shall not be liable for any loss of profits, loss of business, depletion of goodwill and/or similar losses, loss of anticipated savings, loss of goods, loss of contract, loss of use, loss of corruption of data or information, or any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses. If you are booking for, as or on behalf of a business or business employee, that business shall indemnify us against all liabilities, costs, expenses, damages and losses (including any direct or indirect consequential losses, loss of profit, loss of reputation and all interest, penalties and legal and other reasonable professional costs and expenses) suffered or incurred by us arising out of or in connection with your, or your business’, breach or negligent performance or non-performance of these terms and conditions. If you are booking for, as or on behalf of a business or business employee, our total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise arising in connection with the performance or contemplated performance of your booking shall be limited to the fees paid to us under your booking. We shall not be liable for any failure or delay in performance of its obligations which results directly or indirectly from any cause or circumstance which is beyond its reasonable control. The following shall be regarded as examples of such circumstances: act of God, outbreak of hostilities, riot, civil disturbance, acts of terrorism, revolution, the act of any government or authority (including but not limited to refusal or revocation of any license or consent), fire, flood, lightning, explosion, fog or bad weather, interruption or failure of a utility service (including but not limited to electricity, gas, water or telecommunications), renovations undertaken at the property, strikes, lockouts or boycotts, embargo, blockade. Other than in relation to death or personal injury caused by our negligence, or any other liability that by law cannot be excluded or restricted, our liability to you in relation to these conditions is limited to the higher of (i) GBP £1,000; and (ii) the value of the booking made. The Contracts (Rights of Third Parties) Act 1999 shall not apply to this Contract so that no term shall be enforceable by a third party Vehicle Use – Parking Parking is at your own risk and we do not take any responsibility for any damage or loss that may be incurred however caused. Parking must be off road, the lodge has sufficient space for two vehicles. Motorcycles and scooters are forbidden from the park as are commercial vehicles, vans, caravans and motor homes. The Park requires a coded key for entry and exit, and these will be provided on arrival or by prior arrangement. Lost security keys will be charged at £100 each. Services We cannot guarantee, or be held responsible for any failure or interruption of, services to the property, including electricity, water or any damage, telephone, internet and other communications, disruption or noise caused as a result of works being carried out beyond our area of responsibility. However, upon notification by a Guest, we will use reasonable endeavors to maintain and rectify (within a reasonable period of time) all services and issues (within reason) to the property, and will use reasonable endeavours to ensure any contractor is made aware of, and rectifies, such problems within a reasonable period. Warranties The owner does not warrant and is not responsible for the accuracy of any verbal information given or statements made by its employees or agents. You may only rely on the information provided by us in print, website or in correspondence. Right of Entry The owner shall be allowed the right of entry to the Property at all reasonable times for the purposes of inspection or to carry out any necessary repairs or maintenance. Termination The owner reserves the right to deny Guests from taking up accommodation or to terminate this agreement and request the immediate departure all persons from the property in the event of a serious breach of the terms of this agreement. The breach may include but is not limited to the following events; a) Serious damage to the Property which may exceed the damage deposit, b) a criminal or illegal act c) Unreasonable or abusive behaviour d) Excessive noise which could adversely affect the rights of the owners being able to continue to operate the Property for short lettings. e) Involvement of authorities (Park Manager at Swansdown Lodge) or police in any form of complaint investigation. Feedback and Complaints We aim to deliver the best possible service, but in the unlikely event that you are dissatisfied with the service offered, you should notify us in writing or by email/phone as soon as possible. We will acknowledge any complaint within 5 working days, and advise you of the name of the person investigating the problem. After that, we will endeavour to provide a full response within 14 working days. General We reserve the right to change these conditions from time to time. Should guests be in breach any of these conditions, we reserve the right to require that guests vacate their property within 24 hours. These conditions shall be governed by and construed in accordance with the laws of England and the Courts of England shall have exclusive jurisdiction in relation to any claim, dispute or difference concerning these conditions and any matter arising from them. |
